Globally, pedestrians constitute 22% of all road traffic fatalities, and in some countries this proportion is ③ (as high as) two thirds of all road traffic deaths. Millions of pedestrians are non-fatally 4(injuring) - some of whom are left with permanent disabilities. These incidents cause much suffering and grief as well as economic hardship. The answer is 4. I understood why it\'s 4. But I don\'t know why number 2 is right. Isn\'t the infinitive coming after would?

You\'re correct, this is a correct sentence. 
First of, you\'re also right when you mentioned that an infinitive usually comes after modal verbs like would. 
The case on the sentence you have provided though was that \'never to return\' is actually an idiom added to the sentence. It served as a phrase fragment. 

Wherein, we can usually add a phrase fragment to a sentence using a comma or a conjunction.
