In the Korea labor standard act, when employee express his or her voluntary resignation, company accepted his resignation, i will affect the date which is submitted. if not, it will employee can be free after 30 days later after the his resignation declare. in his case, he submit the voluntary resignation letter 2 month before because he wants to provide enough time to find substitute. due to his prior notice, company made a valuable decision. furthermore, local HR didn\'t inform him of Bonus condition that employee; prior resign notice is not entitled his last year bonus. if he knew this condition, he will submit or announce his resignation after the bonus date. in the past, company will not ask him to pay back because of his resignation. He leaves the company expecting to receive the bonus that;s why he leave the company after Feb. our regular payment date is feb payroll. he is on payroll on Feb, he is eligible to receive bonus. honestly we have paid out employee who submitted letter
